These Terms govern your use of TOVA, a shared commute platform operated by Marshbarks Services, Hyderabad, Telangana, India. By registering or booking a ride, you agree to these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing gotova.in or interacting with TOVA via WhatsApp, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms of Service and our Privacy Policy.

If you are using TOVA on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. About TOVA

TOVA is a technology platform that connects verified government employees for shared daily commutes. TOVA is operated by Marshbarks Services, a proprietorship registered in Hyderabad, Telangana, India.

TOVA is not a transport provider. Rides are offered by independent Hosts who use their personal vehicles. TOVA facilitates discovery, booking, and payment coordination between Riders and Hosts but is not a party to the transport contract between them.

The platform is currently in a pilot phase restricted to verified government employees in Telangana and Andhra Pradesh.

3. Eligibility and Accounts

  • TOVA is currently available only to verified government employees in the pilot network. We reserve the right to verify your employment details and suspend access if information is found to be false.
  • You must provide a valid WhatsApp number for registration. This number serves as your login identity.
  • You are responsible for all activity that occurs under your account. Do not share your OTP with anyone.
  • TOVA reserves the right to suspend or permanently ban accounts that violate these Terms, provide false information, or engage in abusive behaviour.

4. Bookings and Payment

  • Bookings are only confirmed upon successful payment via Razorpay.
  • Fares shown on the platform are final and inclusive of all charges. No surge pricing is applied.
  • TOVA collects payment on behalf of the Host. During the pilot phase, no platform commission is deducted.
  • Payment credentials (card, UPI, netbanking) are handled entirely by Razorpay and never stored on TOVA's servers.
  • A booking confirmation is sent to your WhatsApp number after successful payment.

5. Cancellation and Refund Policy

Rider-initiated cancellations:

  • A flat ₹50 cancellation fee applies to all rider-initiated cancellations regardless of timing.
  • The remaining amount (fare paid minus ₹50) will be refunded to the original payment method within 5–7 business days via Razorpay.
  • If the fare paid is ₹50 or less, no refund will be issued.

Host-initiated cancellations:

  • If a Host cancels a trip, all Riders receive a full refund with no deduction.
  • Riders will be notified via WhatsApp immediately upon host cancellation.

No-shows:

  • If a Rider fails to board the vehicle at the agreed pickup point and time without cancelling, no refund will be issued.

6. Host Obligations

If you register as a Host on TOVA, you agree to:

  • Hold a valid driving licence and vehicle registration for the vehicle used for TOVA rides.
  • Ensure your vehicle is roadworthy, insured, and meets all legal requirements under the Motor Vehicles Act, 1988.
  • Operate rides only as a carpooling arrangement — you must also be commuting to the same destination for personal purposes. TOVA is not a commercial taxi service.
  • Notify Riders as early as possible if a trip cannot proceed, using the app or by typing on my way, arrived, or late [minutes] on WhatsApp on the day of the trip.
  • Not charge Riders any amount beyond the fare displayed on TOVA.
  • Maintain professional, respectful conduct with all Riders.

TOVA reserves the right to remove Hosts who receive consistent complaints, cancel trips repeatedly, or violate these obligations.

7. Rider Obligations

As a Rider, you agree to:

  • Be present at the agreed pickup point at the agreed time. The Host is not obligated to wait more than 5 minutes.
  • Verify the Host's name, vehicle, and registration number before boarding.
  • Wear a seatbelt for the duration of the ride.
  • Treat the Host's vehicle with respect — no smoking, no food that may cause mess, no behaviour that damages the vehicle.
  • Raise any safety concern immediately via the SOS button in the app or by contacting support on WhatsApp.
  • Not request or accept rides outside the TOVA platform to circumvent booking and payment.

8. Safety and Emergencies

TOVA operates within a verified network, but we cannot guarantee the behaviour of any individual user. In case of an emergency during a ride:

  • Use the SOS button in the Rider dashboard to alert our support team immediately.
  • Call 112 (Police) or 108 (Ambulance) for immediate emergencies.

All safety incidents must be reported to TOVA within 24 hours for proper documentation. We cooperate fully with law enforcement in all safety matters.

9. Prohibited Uses

You agree not to use TOVA to:

  • Impersonate any person or entity or provide false information during registration or verification.
  • Harass, abuse, threaten, or discriminate against any user, Host, or TOVA staff.
  • Use the platform for any commercial transport purpose (e.g., operating as a taxi or cab service).
  • Circumvent or attempt to circumvent the payment system.
  • Scrape, copy, or reproduce content from the platform without written permission.
  • Attempt to gain unauthorised access to any part of the platform or its infrastructure.

10. Intellectual Property

All content on gotova.in — including the TOVA name, logo, design, and text — is owned by Marshbarks Services. You may not reproduce, distribute, or create derivative works without prior written consent.

By submitting content (e.g., profile information) you grant TOVA a non-exclusive, royalty-free licence to use it for operating and improving the service.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • TOVA is not liable for any indirect, incidental, or consequential damages arising from your use of the platform.
  • TOVA's total liability for any claim arising from a specific booking is limited to the fare paid for that booking.
  • TOVA is not liable for delays, cancellations, or incidents caused by road conditions, weather, accidents, or other events beyond the Host's reasonable control.
  • TOVA does not warrant that the platform will be uninterrupted or error-free at all times.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud.

12. Indemnification

You agree to indemnify and hold harmless Marshbarks Services, its employees, and agents from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, your misuse of the platform, or your interactions with other users.

13. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising from the use of TOVA shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana.

Before initiating legal proceedings, we encourage you to contact our Grievance Officer to resolve the matter amicably. We will respond within 48 hours and aim to resolve within 30 days.

14. Changes to These Terms

We may update these Terms as the platform evolves. Material changes will be communicated via WhatsApp to registered users at least 7 days before taking effect. The latest version is always at gotova.in/terms. Continued use after the effective date constitutes acceptance.
